Did you pay P200 per open case as you said? What BIR Form did you use to pay? Did you pay in the bank? Clarify ko lang kasi sa seminars ng BIR, P1,000 ang sinasabi nilang penalty although some liaison says P200 will do.

yun bookeeper ko po nagbayad sa BIR, di ko pa po nakukuha mga receipts by this month nya ibibigay sa akin lahat pati mga bagong bir books ko, rdo28 ang branch ng bir na sakop ako sir, sa mismong rdo28 sya nagbayad, ang alam ko po kasi na 1,000 penalty e yun sa business place na hindi naka-display ang "ask for receipt", another 1,000 kung wala yun book of accounts sa place of business, another 1,000 kung hindi nak-display ang COR

Thanks for the reply. Yes, yung mga violations na makikita ng BIR Inspectors during Tax Mapping (the ones you cited) carry P1,000 penalty per violation and they should be paid (legally) to the Authorized Agent Banks (AAB) using BIR Form 0605 with the violation ticket as attachment.

Itinatanong ko lang kung paano kayo nagbayad dahil dapat ay sa AAB din magbayad using also BIR Form 0605 with the open case ticket as attachments. I maybe wrong though. I knew about this only in my recent reading about the different BIR forms.

Normally kasi, sa cases na nalimutan na i-file ang 2551M dahil "no operation", pwedeng mag-late filing ng 2551M sa AAB at bayaran lang ang P200 as penalty. Ito ay kung ayaw na ninyong hintayin pa na sa end of the year ma-verify yung open cases ninyo.

@joyblanca, when you get to know, can you please post here how your bookkeeper paid the P200 penalty per open case? It would be a big help if we would know how to legally settle open cases. What forms were used and where did he/she paid the penalties?

kahapon po itinawag sa akin ng maid ko na dinala sa bahay nung bookkeeper ko mga receipts ng binayaran ko, regarding my open cases,na-evaluate pala na meron ako open cases nung i-cms ang account ko, bago magrenew ng books, sop daw na cms muna, 2551M sept. 2007 and 1601E Sept. 2007, yun ang panahon na sinabi ko sa bookkeeper ko na no operation ako dahil nag-aayos kami ng pc at talagang hindi kami nag-operate during that month, kaso hindi pala nag-file ang bookkeeper ko sa bir kaya ayun lumabas sa record ko na meron ako dapat bayaran.

sa Land Bank nagbayad, using BIR tax payment deposit slip attached yung form 2551M and 1601E, tapos po meron naka-tatak na received payments dun sa 2 forms. dinala ulit sa BIR after payment sa bank for verification and account updating tapos chaka pa lang tinatakan ang new books ko.

lesson learned, hindi pala dapat sobrang magtiwala sa bookkeeper ko, kaya teterminate ko na services nya sa akin, meron na akong nahanap na kapalit na mas mura pa ang retainer's fee, sobra itong bookkeeper ko kala mo de-campanilla tinataga ako ng husto, grrrr....

Malinaw na siguro ngayon kung paano ang tamang pag-handle ng open cases. I said and you confirmed it by what your bookkeeper did na we must use the same forms that you failed to file and pay the penalty of P200 per open case at a BIR Accredited Agent Bank. We do not have to wait for the end of the taxable year to do it. File and pay immediately as soon as you realize your failure to file. Also, make sure that you have an accurate and complete files of your BIR documents.

Regarding the negligence of your bookkeeper, if you are paying him/her right, I believe it is just proper that you deduct such costs of negligence from his/her retainer's fee. Such arrangement will make your bookkeeper more responsible on the jobs he/she agreed to do for you.

heto lang po tip ko sa walang pang book keeper pumunta po kayo sa BIR magtanpng tanong regarding BIR payments, tapos hiritan mo ng " ma'am/sir may kilala po ba kayong book keeper..ora mismo sasagot yan ng ano ba problema mo sa payments..ngayon hiritan mo ng na lilito po kasi ako sa mga form forms na yan..actually sila mismo tumatangap ng ganyang trabaho as book keper extra income nila sideline kumbaga.. kc samin yong isang emplayo ng BIR ang book keeper namin.. so far ok naman saka masipag d pa naman ako nag kakaproblema..na titimbrehan pa kami pag may TAX mapping na yan...

isa pa sa mga nag iissue ng resibo..see to it na laging may carbon ang resibo nyo.. once na nahuli kayo ng BIR sa blangkong duplicate tumataginting 10k isang blangkong duplicate..

ang binibigay ko lang po sa book keeper namin is 150 per month..pero kinukuha nya yon tuwing december kasama ng give away namin tuwing dec.

Nakakabadtrip lang sa rent di naman ikaw yung kumikita kung hindi yung may ari ikaw pa mag shoushoulder nun.

Gusto ko lang po i clear ung nag sabi nato.. No, you will not shoulder yung tax ng lessor.. ang ginagawa po sa form 1601-E is that your withholding in advance a portion of their income for tax purposes..kung baga, isa kang withholding agent ng BIR... ibig sbhn., pabor pa nga sayo un kasi magagamit mo pa ung portion na dapat binayad mo sa rent until the 10th month, which is bayaran ng 1601-E... after mo iremit sa BIR ung 1601-E, gagawa ka naman ngaun ng Form 2307 which is a certificate of w/holding tax at source... un ung kelangan ng lessor mo... dahil gagamitin nila un as a proof na you withheld a portion of their tax so that they can use it to deduct to their tax due sa Income tax returns nila....

Every individual has to pay the Income tax..
meron itong Quarterly (1st, 2nd, 3rd)
at ung Annual na tinatawag..
Yung form depends if you are self employed, corporation/partnership,...


Sa mga nalilito sa Percentage tax or VAT.. if your a NON-VAT registered, you will pay the percentage tax w/c is 3% of your GROSS Sales.. un ung 2551M, sa mga VAT tax payer, their sales is inclusive of 12% tax katulad ng sa mga jollibee.. so ang kelangan nmn nila is ung 2550M.. if monthly, 2551Q if Quarterly...

Example mga peeps..

Non-VAT

percentage tax (20 * .03) = 0.60

ibig sabihin, shinoshoulder mo ung tax...


VAT registered

Vatable sales = 17.86
VAT = 2.14

As far as I know, tama lahat ang contents ng post na ito ni kosang amondz. Idagdag ko lang na hindi naman lahat ng lessors (landlords or space owners) ay nag-iinsist na ang lessees (lanshop owners and others) ang magbayad ng expanded withholding tax on rent. Depende talaga ito sa usapan ng lessor at lessee bago magsimula ang pag-lease ng space.

At susugan ko na rin yung obserbasyon ni kosang amondz na ang non-VAT or percentage taxpayer ang nagso-shoulder ng tax samantalang ang 12% sales tax ng VAT-registered taxpayer ay ipinapasa niya sa kanyang customers. What an unfair policy especially nowadays that lanshop rates are really low.
